US H1-B Temporary Work Visas

US H1-B Temporary Work VisasUS H1-B Temporary Work VisasU.S. H-1B non-immigrant visas are for skilled, educated individuals employed in specialized occupations outside of the United States. The H-1B visa enables foreign workers to temporarily work for a specific employer in the United States. US H-1B Temporary Work Visas Recipients of an H-1B visa can remain in the U.S. for three years at a time, but the stay can be extended to a maximum of six years. In certain circumstances, such as when a labor certificate is pending or immigration petition is approved, individuals can apply for more extended stays. H-1B visa holders are also able to recapture time spent abroad to extend their legal status past the expiration of the original approval notice. The only requirement during the length of the stay is that the individual continues to work for the sponsoring employer. In order to stay compliant in status, the foreign national must submit an H-1B Change of Employer (COE) petition to th e government when changing employers. H-1B Visa Eligibility In order to be eligible for an H-1B visa, an individual must have a Bachelors degree in their specific field or an equivalent of 12 years worth of experience. In fields where state licensure is mandatory, such as in law, the individual must have the necessary license, as well. The types of specialized occupations applicable to this type of visa include Agricultural ScienceArchitectureAstronomyBiologyBusiness/managementChemistryComputer ScienceDepartment of DefenseEducationEngineeringGeologyLawMathematicsMedicine/health fieldsPhysicsPsychologySurveying/cartographyTheologyVeterinary scienceWriting Fashion modeling careers are covered under H-1B3 visas, provided that the worker is a fashion model of distinguished merit and ability and that the position requires a fashion model of prominence. When Can You Apply for an H-1B Visa? Individuals themselves cannot apply for an H-1B visa. Rather, an employer must petition for a visa for a specific employee. If an individual meets the requirements, employers can start applying for a visa no more than six months before the expected start date. There is a yearly cap on the number of H-1B visas issued. The annual cap is determined by Congress and is currently limited to 65,000 visas. Up to 6,800 visas are set aside as part of trade agreements with Chile and Singapore. Any unused visas from this allotment return to the swimmingpool for the next fiscal year. The U.S. fiscal year begins in October, and all petitions that are subject to the cap are required in April of the previous year. For the fiscal year 2018, United States Citizenship and Immigration Services (USCIS) began accepting petitions on April 3, 2017. The window closes quickly this year, applications hit the cap in four days. The first 20,000 petitions filed for beneficiaries with a Masters Degree or higher are exempt from the cap. Workers employed by a higher education institution (such as a colleg e or university), a nonprofit organization, or government research organization are also exempt from the annual cap. Those who are H-1B cap-exempt are able to petition all year. However, these visas also go quickly, so its best to file promptly. Protections for H-1B Workers Employers must pay workers on an H-1B visa either the wage paid to similarly qualified workers or the prevailing wage in the geographic location where work takes place. Employers must also provide safe working conditions for all workers. In the event that the employer terminates the workers employment during the period covered by the H-1B visa, the employer must pay reasonable costs for return transportation. This applies in the event of a layoff or termination, but not in the event that the worker resigns their position voluntarily. USCIS encourages visa holders to contact the service center that processed their application if they feel these requirements havent been met. How to Apply for an H-1B Visa Wo rkers cannot apply for H-1B Visas themselves. A sponsoring employer applies on their behalf no more than six months before the requested employment start date. To apply, sponsoring employers must file the appropriate paperwork. For a cap-eligible, specialty-occupation applicant, this includes the Form I-129 petition, including the H Classification Supplement and the H-1B Data Collection and Filing Fee Exemption Supplement. These forms for employers are available on the USCIS website. Depending on the beneficiarys occupation- e.g., fashion model, DOD researcher, etc.- the sponsoring employer may also have to file supporting documentation, including a Labor Condition Application (LCA) and evidence of the beneficiarys educational background. The USCIS websiteincludes the latest instructions and forms for each occupation.

Attention, complainers Venting at work makes you feel even worse

Attention, complainers Venting at work makes you feel even worseAttention, complainers Venting at work makes you feel even worseAfter a long day, its very tempting to throw up your hands and vent about how nothing at work makes any sense.Dont do it. Or if you do rant about your workday, just know that it wont help you.Anew study in the European Journal of Work and Organizational Psychology argues that engaging inunnecessary complaints and criticismcementsthe impact of that negative vorstellung on your psyche and your ability to do work the next day.The study confirms that we arent victims of circumstance we have more control over how events shape us than we think.Evangelia Demeroutiand Russell Cropanzano, at Eindhoven University of Technology and the University of Colorado at Boulder, asked 112 employed people to complete3-day work diaries. The subjects were asked to report about how muchthey complained about their work and to rate their moods.54% of the negative work events the subj ects wrote about in their diaries was related to the work itself- they couldnt finish a task, theymade an error, theircomputer crashed- but social events were also significant. Around 27% of negative events revolved around co-workers, with the subjects citing gossiping, a colleagues firing, and an argument with a co-worker orsupervisoras experiences that riled them up and bummed them out.Not only did focusing on the schwimmbad experiences bother people, it did so for a relatively long time. When something goes wrong at work, its effect on you can last at least 24 hours, the authors found, depending on how you decide to cope. The 24-hour bad moodIf a subject stewed about his work grievances,it would make their bad mood worse. It would also affect their levels of dedication and energy the next day, as seen in subjectsdiary entries. For the ones who didnt complain, the researchers said they exhibited high sportsmanship, which conjures images of opposingathletes shaking hands after a lo ss. For the researchers, they defined good sportsmanship as tolerating less-than ideal circumstances or minor workplace distractions and discomforts without complaining.Researchers found those who didnt complain would feel more engaged with their work until the following afternoon and would be in better moods until the next morning. Even if the subjects experienced bad events they rated as severe, this would show no impact on mood or on engagement if they exhibited high sportsmanship. If you must complain, watch your styleThe researchers suggested that vocalizing what went wrong immediately after it happens forces the brain to relive the moment, thereby creating a stronger association to the event and making it a bigger deal than it needs to be. Jerry chewing with his mouth open right next to your desk is not the end of the world, but when youre in a bad mood, it feels like it.Researchers also suggestedthat rehashing work dramas doesnt work because it may lead you to put your foot in your mouth and say something you shouldnt If the complaint is poorly timed or expressed with too much emotion, then it is less likely to be received constructively and addressed. Giving yourself a day or two to process a negative event mayallow you to handle it more objectively with less personal emotion.Of course, this doesnt mean that if a bad thing happens to you at work, that you shouldnt talk about it ever. Dont bottle up feelings do talk about them to your boss. Make sure theyre important enough to you to bring up, however.Venting just to ventisnt productive, either to your targets or yourself. Studying its effects, Brad Bushman, anOhio State University professor, had 600 college students readgraded papers that the students themselves had written. The graded papers were purposefully designedto rile the students up, criticizing them on their originality, style and organization. He then divided the students into groups. The group that was told to vent by picturing the partner wh o poorly graded them while hitting a punching bag feltthe most hostility and irritation. The group that did no venting felt the least.Bottom line you sometimescant control what happens to you at work, but you can control how you react to it.

The Risks of Your Digital Experience as a Job Seeker

The Risks of Your Digital Experience as a Job SeekerThe Risks of Your Digital Experience as a Job SeekerIn the past, if you were looking for a job, youd crack open the classifieds, circle jobs that interested you (with a pen), then mail in your printed resume and cover letter to a hiring manager and hope for the best. But in todays job market, virtually everything is done, well, virtually. As part of your digital experience, you look for listings zugreifbar, you submit your job application online, you answer questions from a potential employer online- heck, you might even do a portion of your job interview online, too. While all of these advancements in technology are great, theres also a downside, in the form of online risks and consequences, according to the Microsoft story, Online Risks Have Real-World Consequences, New Microsoft Research Shows.According to the study, almost everyone has had at least one negative online experience that resulted in an IRL consequence. In fact, almos t two-thirds (65 percent) of respondents said that they had been a victim of at least one of 17 different online risks. For job seekers, this can definitely mean falling prey to a job scam. Revamp your rep.Studies have shown that the majority of hiring managers will check you out online before contacting you for a job interview. Thats why you want to make aya that what they find is flattering. Those are the profiles that you want a hiring manager to see3. 5 Simple Ways to Get Motivated at Work

5 Simple Ways to Get Motivated at Work5 Simple Ways to Get Motivated at WorkHave you ever tried to get motivated at the office- but nothing works? You start to feel terrible, like youre falling behind in your business or career. Youre bored, lethargic, and you dont want to meet up with your friends because you dont want to talk about what youve been doing. (Or, more accurately, what you havent been doing.)Ive totally been there, too, and Ive felt the frustration that comes from a lack of motivation at work. But Ive also got some good news. There are some key things that contribute to your work being motivating (or not), and once you recognize them, you have the power to redesign your workday in a way that gets you moving. Here are five things you should make sure youre getting out of your day-to-day tasks- and if youre not, the changes you can make to jump start your motivation.1. Task IdentityWork is fruchtwein motivating when its clear what, exactly, youre accomplishing. Think about it How great does it feel when you know youve gotten a launch off the ground or made great progress on big project? On the other hand, nothing is worse than working all day and thinking What did I even do today? If youre feeling like youve been spinning your wheels, try this At the end of each day or week, make a Got Done list (the opposite of to the to-do list), where you outline all of the tasks youve completed. For extra motivation, keep it somewhere you can see.2. Task SignificanceAnother key to staying motivated is knowing that the work youre doing makes a difference in some way- recognizing the impact youre making on your clients, company, or the world. If youre not totally seeing this connection, try to dig deep. You could map your weekly sales reports to the increase in your companys bottom lines or sales unit, for example. Or, say a key metric your company tracks is customer acquisition cost. Make a list of the tasks you do that reduce this cost for your company, and find way s to focus on those aspects of your job more often.3. Skill VarietyFeel like youre doing the same old repetitive work, day after day? Its not so stimulating, to say the least. But when youre engaging lots of different skill sets- thats fantastic for your motivation.Try to structure your days so that youre working on different tasks (and thus, making use of different skills) throughout the day. For example, instead of writing all day on Monday and then building your client presentations on Tuesday, try to do both in smaller three-hour chunks each day. When you stimulate different parts of the brain, your motivation will be recharged.4. FeedbackOne of the most motivating factors you can have is getting feedback on your work. Not only for the ego boost you get when youve done a good job, but because the right feedback can help you hone your skills even further. It can also help you see the difference that your work is making. On the contrary, if you dont know how youre performing, its easy to lose steam. If find that youre in a black hole of feedback, ask your manager, or even a colleague, for standing check-in meetings every one or two weeks. Let her know that youd like to use the time to check in on your projects, and that youd love honest feedback on where you could improve.5. AutonomyFinally, this is a big one having autonomy in your job. Now, this doesnt mean that you always get to do what you want- it just means you get a domain of choice about how youre doing things. For example, say you need to secure three more clients for the month. Its much more motivating to be able to determine how to do that on your own- perhaps you want to build your online presence, or perhaps you enjoy building relationships offline. Sure, in the corporate world, there are plenty of things that have to be done a certain way- but there are also plenty of places where you can ask your boss for more autonomy. And that brings me to my final point Unless you work for yourself, you probab ly dont have the power to totally rewrite your job description. But what you can do is communicate with your manager. You can identify the skills you want to develop, ask for feedback more often, probe for clarification when tasks are not clearly identified or seem insignificant, or ask to take on different tasks or have more autonomy on a project.More than likely, youll be able to change something about your workload. And not only will you be more motivated- your boss will be impressed youve taken the initiative. So whats getting in the way of you being motivated at work? Find out, and then find a solution.Photo of woman working courtesy of Shutterstock.
